Terms of service

Last updated: [Datum der Veröffentlichung]

This is a convenience translation. The German version is legally binding.

1. Scope & provider

These terms apply to the use of the "Dormo" app and the associated website. The provider is [Name/Firma, Anschrift, siehe Impressum] ("we"). Deviating terms of users do not apply. For purchases via the App Store or Google Play, Apple's or Google's terms also apply.

2. Dormo's services

Dormo offers audio and video content for relaxation (including guided meditations, breathing exercises, sleep stories, music and sounds), a sound mixer, sleep tracking with sound detection, a sleep diary as well as reminders and statistics. Some features are free ("Free"), further content and features are available with a paid subscription ("Premium"). The app indicates which content is included. We continuously expand and update the offering; there is no entitlement to specific individual content as long as the nature of the service is preserved.

3. Health notice

Dormo is intended for relaxation and self-observation. The app is not a medical device, does not make diagnoses and does not replace medical, psychotherapeutic or other medical advice or treatment. Sleep tracking results (e.g. score, detected sounds) are estimates and may be inaccurate. If you have health problems, especially suspected sleep apnoea, persistent insomnia, depression or anxiety disorders, please see a doctor or psychotherapist. Do not use audio content while driving or doing anything that requires your full attention.

4. Account

The app can initially be used without registration. An account is needed to use it on several devices and for web purchases. You must provide truthful information and protect access to your account from third parties. You can delete your account in the app at any time; this does not automatically cancel an active store subscription (see section 6).

Use is permitted from age 16; younger people need the consent of their legal guardians.

5. Premium, trial & prices

All prices include statutory VAT. In other countries and currencies the prices shown in the app or store apply. For in-app purchases, payment is made via your Apple or Google account; for purchases on our website via our payment provider Stripe.

Trial: If you don't cancel at least 24 hours before the end of the trial, it automatically converts into the chosen paid subscription and is charged at the stated price. The trial can only be used once per person.

Price changes for active subscriptions will be announced in good time. They only apply from the next billing period and, where required by law or the store, only with your consent. If you don't agree, you can cancel at the end of the current period.

Gift cards

On our website you can buy gift cards for Premium or the family plan (one-off payment, no automatic renewal). The gift card can be redeemed for three years from purchase, can only be redeemed once and cannot be exchanged for cash. The term (e.g. 12 months) starts on redemption; if a gift card is already running, the new term is added. We are not liable for loss of the code or its disclosure to unauthorised persons as long as we are unaware of it; report suspected misuse immediately so we can block the code. The right of withdrawal (section 8) applies to gift cards as long as they have not been redeemed.

6. Term & cancellation

Subscriptions renew automatically for the chosen period (one month or one year) unless cancelled at least 24 hours before they expire. You can cancel at any time with effect from the end of the current period:

Periods already paid for are not refunded pro rata unless otherwise required by law. Refunds for in-app purchases follow Apple's or Google's rules. The right to terminate for good cause remains unaffected.

7. Family plan

With the family plan, the purchasing person (manager) can invite up to five other people to Premium via an invitation link. Each person uses their own account; personal data such as history, mixes or sleep data are not visible to other members. The manager must be an adult and may only share the subscription with people from their own household or family. When the family plan ends, the members' Premium access ends too.

8. Right of withdrawal for consumers

For purchases in the App Store or on Google Play, Apple's or Google's withdrawal and refund rules apply, as the contract of purchase is concluded there. The following information applies to subscriptions you take out directly with us via the website.

Withdrawal information

Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded. To exercise your right of withdrawal, you must inform us ([Name/Firma, Anschrift, E-Mail]) of your decision to withdraw from this contract by means of a clear statement (e.g. an email). You may use the model withdrawal form below, but it is not mandatory. To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal: If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal. We will use the same means of payment you used for the original transaction unless expressly agreed otherwise; in no event will you be charged any fees for this reimbursement. If you requested that the service begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of services provided until the withdrawal compared to the total scope of the services provided for.

Early expiry: For a contract for the supply of digital content not on a tangible medium, your right of withdrawal expires when we have begun performance of the contract after you have expressly agreed that we begin performance before the end of the withdrawal period and have acknowledged that you thereby lose your right of withdrawal.

Model withdrawal form

(If you want to withdraw from the contract, please fill in this form and send it back.)

I/We (*) hereby give notice that I/we (*) withdraw from my/our (*) contract for the provision of the following service / the supply of the following digital content (*): ______
Ordered on (*) / received on (*): ______
Name of consumer(s): ______
Address of consumer(s): ______

9. Usage rights & obligations

For the duration of use we grant you a simple, non-transferable right to use Dormo's content in the app for private, non-commercial purposes. You may not copy content out of the app, distribute it, reproduce it publicly, circumvent technical protection measures, decompile the app (unless permitted by law) or share access with people outside a family plan. In the event of serious violations we may block the account after a prior warning.

10. Availability & changes

We strive for availability with as few interruptions as possible but cannot guarantee it, for example during maintenance, outages at service providers or force majeure. Certain features (e.g. streaming) require an internet connection. Sleep tracking requires your device to allow background recording and to be sufficiently charged; we cannot guarantee that every night is recorded in full or that the alarm goes off under all circumstances. Do not rely solely on the Dormo alarm for important appointments.

We will notify you of changes to these terms in the app or by email at least six weeks before they take effect. If you do not object within this period, the changes are deemed accepted; we will point out this right to object and its consequences separately in the notice. We do not change essential contractual obligations and prices in this way.

11. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. In the event of a slightly negligent breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), our liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded. These limitations also apply in favour of our employees and agents.

12. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another EU country, the mandatory consumer protection provisions of that country remain unaffected. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. Should any provision be invalid, the validity of the remaining provisions remains unaffected.

Information on data protection can be found in our privacy policy.
